Why CLARTY Act is Delayed?

Lawmakers have been facing immense pressure to pass the CLARITY Act since its introduction to the Senate. However, the Senate’s upcoming election priorities, the stablecoin provision disputes, and the debates regarding the overlap between the Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC) have been delaying the process.

In addition, Trump’s latest revenue disclosure has created obstructions in passing the act. According to the 927-page report, the Trump family generated $1.4 billion of the total $2.2 billion in revenue from crypto-related businesses. This includes crypto holdings, World Liberty Financial (WLF) profits, token sale business, and additional earnings from various digital assets. 

Senator Elizabeth Warren accused Trump of using the presidency to boost his family’s crypto business, and stated on X that the act will worsen the ongoing crypto exploits by creating new loopholes. Senator Cynthia Lummis responded to this by pointing out that the act has more than 16 illicit finance safeguards, and accused Elizabeth Warren of baseless attacks. “Two hundred and fifty years of American innovation, American freedom, and American grit. The CLARITY Act is this generation’s contribution to that legacy. Let’s finish the job!” Cynthia Lummis tweeted on X. 

What’s Next for the CLARITY Act?

Senate’s final date to be in session before its summer recess is August 7th, 2026; the next crucial date to watch. Senate will likely evaluate the different versions of the act passed by the Banking Committee and Agricultural Committee, and create a final version for the voting process.

If passed, we can witness the final approval by the president soon. If the bill is not finalized before the recess, we will witness the delay extending to 2030. This is due to focus shift of the Senate to the upcoming elections.

How CLARITY Act’s Delay Affects the Crypto Market?

The delay in the CLARITY Act will negatively affect U.S.-based blockchain businesses and the entire crypto market altogether. As an act that categorizes digital assets into securities, digital commodities, and stablecoins, the delay will witness the lack of a clear definition for various assets.

At present, the entire crypto market is going through an uncertain phase, in which the total market capitalization has reduced to $2.17 trillion, and the Fear and Greed Index is at 27 (Fear).
